These Terms and Conditions apply to the use of this website and to all online courses, videos, written materials, downloads and other educational content supplied by SUPport PROductions Ltd (“we”, “us” or “our”).

By purchasing, accessing or using one of our courses, you agree to these Terms and Conditions.

1. Educational Purpose

Our courses and other materials are provided for general education and information.

Stand up paddleboarding and other watersports involve inherent risks. Conditions, equipment, individual abilities and circumstances vary considerably, and no online course can take account of every situation that a paddler may encounter.

The information provided in our courses is not a substitute for appropriate personal judgement, practical instruction, local knowledge, professional advice or assessment of the actual conditions at the time of an activity.

You are responsible for deciding whether an activity is appropriate for you and for taking reasonable precautions for your own safety and the safety of others.

2. Accuracy and Currency of Information

We make reasonable efforts to ensure that the information contained in our courses is accurate and appropriate at the time the course is prepared or last updated.

However, information relating to stand up paddleboarding, safety practices, equipment, training methods, regulations, industry guidance and other subjects may change over time.

We do not warrant that every statement or recommendation contained in a course will remain current, complete or applicable to every location or circumstance.

New research, changes in accepted practice, changes in equipment, changes in legislation or regulations, or information that becomes available after a course was produced may supersede information contained in the course.

Where appropriate, users should check current information from relevant authorities, manufacturers, governing bodies and other reliable sources before relying on course material.

If you become aware of information in one of our courses that you believe is incorrect or out of date, we encourage you to contact us.

3. Safety and Assumption of Risk

Stand up paddleboarding and related activities take place in environments that may present hazards including, but not limited to, weather, wind, waves, currents, tides, cold water, obstacles, other water users and changing environmental conditions.

Participation in any activity described or demonstrated in our courses is undertaken at your own risk.

You are responsible for assessing your own ability, experience, health, equipment and the conditions before undertaking an activity.

Nothing in our courses should be interpreted as an assurance that a particular activity, location, technique or set of conditions is safe for a particular person.

If you are uncertain about your ability to undertake an activity safely, you should seek appropriate practical instruction or professional advice before proceeding.

4. Local Laws, Regulations and Guidance

Rules and regulations affecting paddleboarding and other water activities vary between countries and locations and may change over time.

It is your responsibility to determine and comply with the laws, regulations, navigation rules, bylaws and official safety requirements that apply in the location in which you are paddling.

Where a course refers to a particular law, regulation or official recommendation, that information should be regarded as applying at the time and in the jurisdiction specified unless stated otherwise.

5. Health and Fitness Information

Any information concerning fitness, exercise, training, nutrition or physical performance is provided for general educational purposes only and is not medical advice.

Individuals vary considerably in their health, fitness, physical capabilities and response to exercise.

You are responsible for determining whether an exercise or training programme is suitable for you. If you have a medical condition, injury, health concern, or uncertainty about your ability to participate safely, you should seek advice from an appropriately qualified health professional.

6. Equipment

References to particular types of equipment, safety equipment or equipment configurations are general recommendations unless expressly stated otherwise.

You are responsible for ensuring that any equipment you use is suitable for its intended purpose, appropriate to your ability and circumstances, correctly fitted and maintained, and used in accordance with the manufacturer’s current instructions.

Equipment specifications, designs and manufacturer recommendations may change after course material has been produced.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any loss, injury, damage, cost or expense arising from or connected with:

  • the application or interpretation of information contained in our courses;

  • participation in an activity demonstrated, described or discussed in our courses;

  • information that has subsequently become inaccurate or outdated;

  • circumstances, environmental conditions or individual factors that could not reasonably have been taken into account when the course was produced; or

  • a user’s failure to follow applicable laws, official guidance, manufacturer instructions, safety advice or reasonable safety precautions.

Nothing in these Terms and Conditions excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, restricted or modified under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable law.

8. Course Outcomes

We do not guarantee that completion of a course will result in a particular level of skill, fitness, performance or competence.

Learning outcomes depend on many factors, including the participant’s previous experience, physical capabilities, practice, equipment and environmental conditions.

Unless expressly stated otherwise, completion of an online course does not constitute a professional qualification, licence or certification of competence.

9. Course Access

Purchase of a course provides the purchaser with a personal, non-transferable right to access the course for the access period specified at the time of purchase.

Login details must not be shared with another person.

We may suspend or terminate access where we reasonably believe that an account is being shared, course material is being copied or redistributed without permission, or these Terms and Conditions have otherwise been materially breached.

10. Intellectual Property

Unless otherwise stated, all course materials, including videos, text, graphics, photographs, diagrams, presentations, downloadable resources and other content, are owned by or licensed to SUPport PROductions Ltd and are protected by applicable intellectual property laws.

Course materials are supplied for the purchaser’s personal use only.

They may not be copied, reproduced, republished, distributed, sold, publicly displayed or made available to another person without our prior written permission, except where permitted by law.

11. Third-Party Content and Links

Courses or this website may contain links or references to third-party websites, products, organisations or resources.

Such references are provided for information or convenience and do not necessarily constitute an endorsement.

We are not responsible for the accuracy, availability or content of third-party resources, or for subsequent changes made to them.

12. Changes to Course Content

We may update, amend, replace or remove course material where we consider this appropriate, including where information has become outdated or where improved information becomes available.

Minor changes to course structure, presentation or content do not create an entitlement to a refund.

13. Consumer Rights and Refunds

Nothing in these Terms and Conditions is intended to limit your rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable consumer protection legislation.

Where you are legally entitled to a remedy, these Terms and Conditions do not affect that entitlement.

Any additional refund or cancellation policy applying to our courses is set out in our Refund Policy.

14. Privacy

Personal information collected through this website is handled in accordance with our Privacy Policy and applicable privacy law.

15. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

Subject to any rights you may have under applicable consumer law, any dispute relating to these Terms and Conditions or our courses will be subject to the jurisdiction of the courts of New Zealand.
